Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of the LinkFlow website, products, and services (collectively, the “Services”). By signing up for, accessing, or using the Services you agree to be bound by these Terms and the applicable Order Form or Subscription Agreement. If you are accepting these Terms on behalf of an entity, you represent that you have authority to bind that entity.

2. Definitions

"Account" means the LinkFlow user account used to access the Services.
"Customer Data" means all data, content, and information submitted or uploaded by you to the Services.
"Order Form" means any ordering document that references these Terms and sets forth the Services, fees, and other terms specific to the purchase.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and up-to-date information and promptly update account information if it changes. LinkFlow may suspend or terminate access for accounts that are inactive, fraudulently used, or that breach these Terms.

4. Services

LinkFlow will provide the Services described in the Order Form. LinkFlow may modify or update features, APIs, or functionality from time to time. We will use reasonable efforts to notify customers of material changes. Non-material changes may be made without notice.

Service availability targets where provided are goals and not guarantees. You are responsible for your own network connectivity and integrations with third-party systems.

5. Billing & Payment

Fees, billing cycles, and payment terms are set forth in the Order Form. Unless otherwise agreed, fees are non-refundable. You agree to provide valid payment information and authorize LinkFlow to charge the payment method on file.

LinkFlow may suspend or terminate your access for non-payment if invoices are not paid within the agreed terms.

6. Data & Privacy

LinkFlow’s Privacy Policy explains how we collect and use personal data. By using the Services you consent to the collection, transfer, and processing of data as described in the Privacy Policy. Customer Data remains the property of the Customer. LinkFlow will process Customer Data only to provide the Services and as otherwise instructed by the Customer.

7. Acceptable Use

You agree not to use the Services to: (a) violate any law; (b) transmit harmful content (malware, spam, or illegal content); (c) attempt to gain unauthorized access to LinkFlow systems; or (d) interfere with normal operations. LinkFlow may investigate violations and take reasonable remedial measures.

8. Termination

Either party may terminate the Order Form for material breach if such breach is not cured within 30 days after written notice. LinkFlow may immediately suspend or terminate access for violations of these Terms or illegal activity.

Upon termination, Customer access to the Services will end. Customer may request a copy of Customer Data within 30 days following termination; LinkFlow may delete data thereafter in accordance with its retention policy.

9. Warranty & Liability

The Services are provided “as is” and LinkFlow disclaims all warranties except as expressly stated in the Order Form. To the maximum extent permitted by law, LinkFlow’s aggregate liability under these Terms is limited to the fees paid by Customer in the 12 months preceding the claim. Neither party will be liable for indirect, incidental, or consequential damages.

10. Governing Law

These Terms are governed by the laws of the jurisdiction specified in your Order Form or, absent such specification, by the laws of the state/country where LinkFlow is incorporated. Any disputes will be resolved in the competent courts of that jurisdiction, except where arbitration is agreed.
